Privacy Policy and Notification

Toshiba (Australia) Pty Limited and its related Toshiba group companies (‘TOSHIBA’) are committed to protecting your privacy.

TOSHIBA is bound by and committed to complying with the Australian Privacy Principles as provided within the Privacy Act 1988 (Commonwealth) (“the Act”) and any other relevant laws, regulations, and/or codes that relate to your Personal Information.

This policy outlines how TOSHIBA treats Personal Information that it collects, receives and holds that is regulated by the Act. The definition of “personal information” is quite broad, and refers to information that is about you, in any form, and that could reasonably identify you. Examples of such information include, but are not limited to your name, contact details, address, email address(es), social media information, credit history information, payment card details and bank account details.

TOSHIBA considers the management of Personal Information to be of paramount importance and commits to treating Personal Information in the manner it would expect others would treat its Personal Information. Options available to TOSHIBA with regard to management include, but are not limited to use of password-protected technology, use of encryption technology and/or the use of Confidentiality Agreements.

What information do we collect?

The types of information TOSHIBA collects about an individual will depend on the type of relationship we have with them.  For example, if we have contact with them in the course of our business or respond to their enquiry, we may collect their name, address and other contact information.  If we supply them with our products or services we may hold additional information about their financial status, order history, preferences, computer settings and their transactions with us.

We only collect information that is reasonably necessary for our business purposes and to enable us to provide goods and services to you.  . Examples include, but are not limited to TOSHIBA collecting your Personal Information when you visit or use TOSHIBA web pages, use TOSHIBA software, use TOSHIBA apps or equipment, request or send information through this website or our products, purchase through this website, apply for a credit account with TOSHIBA, and/or when you send feedback to, or otherwise deal with TOSHIBA. When you request information through this site or the site of a related party, we need to know the location that information is to be sent to, and we will use this location to send to you relevant information.

We will usually collect an individual’s personal information directly from them, unless it is not reasonable or practical to do so, or they have consented to us obtaining the information from someone else.  When you send feedback, we ask for relevant contact details to thank you for your contribution and if required, to request more information. If you provide feedback to us, you agree that information shall be deemed to be non-confidential, and TOSHIBA may use such information on an unrestricted basis.

When you apply for a credit or other account with TOSHIBA, we may ask for Personal Information such as your name, address, telephone number, email address, employment details, bank details, and any other Personal Information we believe may be relevant to the application, including the consideration . By completing and submitting a credit application to TOSHIBA, you are not acting in an anonymous manner.

When you purchase products online from TOSHIBA, we ask for Personal Information such as your name, address, telephone number, email address and payment details (e.g credit card details), as well as other Personal Information we believe may be relevant to the purchase. By purchasing products online from TOSHIBA, you are not acting in an anonymous manner.

We may collect and use technical information, including, information about your device, system and application software, and peripherals gathered periodically to facilitate the provision of software updates, product support, and other services to you, if any, related to the services.

TOSHIBA may also automatically receive and record information from the use of our site, apps or through software that we use in our business operations. Such information may include your server address, top level domain name (eg. .com, .gov, .au etc), the date and time of the visit, information being printed, the pages accessed, documents downloaded, the previous site visited, as well as general information about browsing habits and behaviour. By gathering information about your preferences and attributes, we can tailor our service offerings and interactions to your needs, and ultimately, provide you with goods and services in accordance with your requirements.

TOSHIBA may also collect your personal information from third parties such as credit providers, fraud bureaus and credit reporting bodies. Contact information and credit and other information may be collected from third parties when assessing any application for a credit account, guarantee, or the supply of goods and services.

An individual need not provide us with personal information if we request it from them, but it may affect our ability to provide them with products, services or further information they have requested.

Using and disclosing your personal information

TOSHIBA may use an individual’s personal information to:

  • efficiently administer and manage the supply of our products and services
  • provide information to them about other products or services that may be of benefit to them
  • respond to any enquiries or complaints;
  • provide goods and/or services to them,
  • assessing any applications for credit, processing and
  • facilitate our internal business operations

TOSHIBA may disclose your personal information to persons and organisations such as:

  • Credit providers, credit reporting bodies, guarantors and third parties to assist in assessing any applications for credit;
  • Third party suppliers involved in administering any credit account with TOSHIBA, and to whom personal information is usually disclosed, with these suppliers including debt collectors, legal advisors, and trade insurers;
  • Third party suppliers involved in the performance of services by or for TOSHIBA, the delivery of goods or services, and the processing of any order placed with TOSHIBA such as transporters, warehouses, financial institutions, merchants and payment organisations; and

Third party suppliers involved in the day-to-day business operations of TOSHIBA, including reviewing, maintaining and upgrading TOSHIBA’s business systems and the management of TOSHIBA’s practices, policies and procedures.Your personal information may also be used in connection with purposes associated with such organisations.

TOSHIBA may also disclose information to other organisations where:

  • You have provided your consent;
  • TOSHIBA is required to respond to a subpoena or subsequent to legal compulsion;
  • TOSHIBA believes it is necessary to assist in lessening or preventing a serious threat to life, health or safety of any individual, or to public health;
  • where acting in good faith, we believe that the law requires or permits us to do so (eg. to law enforcement agencies or government auditors); and
  • TOSHIBA believes it is reasonably necessary in taking action in relation to suspected unlawful activity, serious misconduct, locating a missing person, or as is required or authorised under Australian law or a court/tribunal order

TOSHIBA may also disclose your personal information to overseas recipients. It is not reasonably practical to list all the countries in which the recipients of your information are likely to be located, but it is likely such countries will include Toshiba related companies in Japan, USA and Singapore, and you consent to this disclosure by providing personal information to TOSHIBA. In providing this consent, you understand that the overseas recipient may not be accountable under the Act and you may not seek redress under the Act. Whilst the overseas recipient may not be subject to similar obligations as the Australian Privacy Principles, TOSHIBA will make reasonable efforts to ensure the overseas recipients uphold the principles of the Australia Privacy Principles

Storing and protecting your personal information

We take reasonable steps to protect an individual’s personal information from misuse, loss, unauthorised access, modification or disclosure. 

TOSHIBA stores your personal information in several different ways, which may include storage in electronic form or in paper form.

Information is stored securely whether in an electronic or physical form.  For example, only personnel needing access to the personal information are allowed access.  Their personal information is stored in secured premises or in electronic databases requiring logins and passwords. We also implement security access procedures to databases, confidentiality agreements for our employees, and by only allowing access to personal information to individuals once TOSHIBA is satisfied identification requirements have been met.

TOSHIBA may use or disclose your personal information to let you know about our products and services or promotions that might be of interest to you. Access to your personal information

An individual has the right to request access to personal information held by TOSHIBA, subject to several exceptions authorised by law.

Correcting your personal information

You have a right to request to correct your Personal Information held by TOSHIBA. Accordingly, TOSHIBA will inspect your Personal Information, and advise you as to whether TOSHIBA believes this Personal Information needs to be corrected.

We try to ensure that all information we hold about an individual, which we collect, use or disclose is accurate, complete and up to date.  They must promptly notify us if there are any changes to their personal information.
